Question : What are the problems concerning of the Collegium System and can NJAC solve them?

The Collegium System of Judicial appointments came into existence by virtue of Second Judges Case (1993). The present collegium system consists if Chie Justice of India and four senior-most Judges of Supreme Court. 

The Concerns in Collegium System

1. Opaqueness and lack of Accountibility - Collegium decisions are not answerable to any external authority - neither Parliament nor Executive.

2. Not Inclusive in nature - Under-representation of Women and Marginalized Community.

3. Constitutional Ambiguity - Collegium has evolved from Three Judges Case and not through Parliamentary process of enacting a law.

4. Nepotism and Favourism

5. Non - Transparent in nature

6. Vacancy due to persistent standoff between Collegium & Executive.

Hence recently the Chief Justice of India Surya Kant orally said that Supreme Court will consider the plea seeking revival of National Judicial Appointments Commission (NJAC) and end the Collegium System.

NJAC, a six membered homogeneous body which will act as Check & Balance ensuring transparency and accountibility in judicial appointments and hence will solve the problem arising from Collegium System.
